1. Acceptance of These Terms
These Terms of Service (the “Terms”) form an agreement between you and Airworthy Academy (“Airworthy Academy,” “we,” “us”) covering your access to and use of our websites, applications, course material, practice questions, and related features (together, the “Services”).
When you create an account you are asked to confirm, explicitly, that you agree to these Terms and acknowledge our Privacy Policy. We record which version of each document you accepted. Continuing to use the Services also constitutes acceptance of the Terms then in force.
If we make a material change to these Terms, we may ask you to accept the updated version before you continue using the Services. If you do not agree to these Terms, please do not use the Services.
If you are using the Services on behalf of an organization, you confirm that you have authority to accept these Terms on its behalf.
2. Eligibility and Your Account
The Services are intended for adults. To use them you must be at least 18 years old and at least the age of majority where you live, and you must be able to form a binding contract with us under applicable law. Where the age of majority where you live is higher than 18, that higher age applies.
Airworthy Academy is not directed to children, and we do not knowingly permit anyone below those ages to create an account.
Your account is personal to you
Accounts and subscriptions are individual. One account is intended for one person, and your access is licensed to you rather than to a household, a flight school, a club, or a group of students.
You may use your own account on your own devices — for example a laptop, a tablet, and a phone. We do not impose a device limit.
You may not:
- Share your login credentials with anyone else.
- Sell, rent, lease, or transfer your account or subscription.
- Allow multiple people to use a single personal subscription.
- Deliberately circumvent per-user licensing or access controls.
Keeping your account secure
Please take reasonable steps to keep your credentials secure, and tell us promptly if you believe your account has been accessed without your permission.
You are responsible for activity that takes place under your account. You are not responsible for unauthorized activity that you could not reasonably have prevented, provided you report it to us promptly once you become aware of it.
3. What Airworthy Academy Provides
Airworthy Academy provides aviation education for ground-school preparation and general aviation knowledge. Depending on what we have released, the Services may include lessons, written explanations, diagrams, practice questions, practice examinations, progress tracking, and study tools covering subjects such as aerodynamics, regulations, weather theory, navigation, aircraft systems, aeronautical decision-making, and knowledge-test preparation.
Keeping our material current
We work to maintain accurate, useful, and current educational content, and we update our materials as regulations, guidance, testing standards, and other aviation information change.
Aviation information does change, however, and sometimes it changes quickly. We cannot guarantee that every item of content is complete, error-free, or current at every moment. Where something we publish differs from a current authoritative source, the authoritative source governs — see “Aviation Safety and Training Boundaries” below, which sets out those sources and what remains your responsibility to verify.
We are not the Federal Aviation Administration, and the Services are not an official FAA publication, an official source of regulatory information, or a substitute for either.
4. Aviation Safety and Training Boundaries
This is the most important section of these Terms. It describes what the Services are for and, just as importantly, what they are not for.
A study resource, not an operational authority
We do not replace instruction or endorsements
Providing the Services does not make us your flight instructor, ground instructor, or any other authorized person. Where instruction, training, an endorsement, or a sign-off must be given by an appropriately qualified or certificated individual, the Services do not provide it and cannot substitute for it.
Authoritative sources take precedence
Where our material differs from a current authoritative source, the authoritative source governs. Depending on the situation, those sources may include:
- Current federal aviation regulations.
- Current FAA publications, handbooks, and guidance.
- Notices to Air Missions (NOTAMs).
- Current weather information and official briefings.
- Air traffic control instructions and clearances.
- Approved aircraft documents, including the POH or AFM.
- Applicable operating limitations and checklists.
- Qualified instructors, mechanics, and other aviation professionals.
- Other authoritative operational sources that apply to your flight.
Do not rely on the Services operationally
You should not rely solely on the Services, or on any AI feature within them, when making real-world decisions involving matters such as aircraft airworthiness, in-flight emergencies, live weather evaluation or go/no-go decisions, fuel sufficiency, aircraft-specific limitations or procedures, live ATC clearances, or regulatory compliance.
You remain responsible for:
- The safe operation of any aircraft.
- Your responsibilities as pilot in command, where applicable.
- Your compliance with applicable regulations.
- Appropriate preflight action and operational planning.
- Consulting current, authoritative information.
- Obtaining the instruction and professional guidance your situation requires.
Attention during safety-critical tasks
Studying around aviation is ordinary use of the Services. Reviewing a lesson at the airport, in an FBO, or while preparing for a flight is entirely appropriate, and nothing here discourages it.
Attention is what matters. Please do not interact with the Services in any way that distracts you while you are operating an aircraft, taxiing, or carrying out any other safety-critical aviation duty. When a task needs your attention, it comes first.
5. Outcomes, Certificates, and Endorsements
We will do our best to prepare you well. We cannot promise a result, and we do not guarantee that you will:
- Pass an FAA knowledge test.
- Pass an oral examination, practical test, or checkride.
- Obtain any pilot certificate or rating.
- Qualify for, or obtain, any medical certificate.
- Complete any aeronautical experience requirement.
- Receive any instructor endorsement.
- Obtain employment or any other professional outcome.
Some Airworthy Academy courses or features may expressly state that they include a certificate of completion, an endorsement, or similar documentation, and may set out the specific requirements for it. Unless a particular offering expressly says so, completing our content does not itself constitute, satisfy, or guarantee any FAA-required endorsement, certification, or similar authorization.
6. AI Features and Our Curated Curriculum
The Services may include AI-assisted features that answer questions, explain concepts, or help you study. These features are educational assistance.
AI responses can be wrong
Responses generated by AI features may contain errors, may be incomplete, and may become outdated. They should not be treated as an authoritative source for safety-critical or regulatory decisions, they should be checked against current authoritative sources where it matters, and they do not replace a certificated flight instructor or another appropriately qualified aviation professional.
Our curriculum is curated and editorially controlled
Our core instructional curriculum is not generated on demand. The lessons, explanations, and practice questions we publish as curriculum are selected, reviewed, and approved by Airworthy Academy before publication. We may use software and AI tools in producing that material — for research, fact-checking, editing, rewording, quality review, and production support — but the published result is editorially controlled by us.
Responses that an AI feature generates for you in real time are different. They are produced dynamically in response to your input, they are not individually reviewed by us before you see them, and they carry the limitations described above.
Availability and fair use of AI features
Running AI features has an operating cost that scales with use. We may therefore apply reasonable limits to them, such as usage limits, message limits, rate limits, allowances that differ by plan, and limits on availability. These may vary by subscription tier, by feature, and according to technical capacity, abuse prevention, and other reasonable operational considerations.
Where a limit applies to a paid plan, we will tell you what it is. We may also change, suspend, or withdraw AI features as described in “Service Availability and Changes” below.
We do not use your AI conversations to improve our AI unless you turn that on
We do not use your conversations with our AI features to improve our AI or our products by default. Any setting that enables such use is off unless you affirmatively turn it on.
If you do enable it, we may use eligible interactions to improve our educational and AI features, as described in our Privacy Policy and in the controls we disclose to you at the time.
7. Your Responsibilities
When using the Services, you agree to:
- Provide accurate account information and keep it reasonably current.
- Use the Services in compliance with these Terms and applicable law.
- Keep your account credentials secure, as described in “Eligibility and Your Account” above.
- Meet the aviation responsibilities described in “Aviation Safety and Training Boundaries” above whenever your real-world flying is involved.
You are responsible for the devices, software, and internet connectivity you use to reach the Services.
8. Acceptable Use
These restrictions exist to keep the Services working and available. You agree not to:
- Use the Services for fraud, or for any unlawful purpose.
- Attack, overload, or deliberately disrupt the Services or the infrastructure they run on, including by distributing malware.
- Access, or attempt to access, areas, accounts, or data you are not authorized to reach, or bypass authentication, paywalls, or other access controls.
- Engage in credential abuse, including credential sharing, credential stuffing, or trafficking in account credentials.
- Conduct unauthorized large-scale scraping, harvesting, or automated extraction of content from the Services.
- Run automation that materially interferes with the Services or with other users’ access to them.
- Reverse engineer, decompile, or disassemble the Services, except to the extent applicable law expressly permits it despite this restriction.
- Substantially copy or redistribute our content without authorization, as described in “Airworthy Academy Intellectual Property” below.
- Resell, sublicense, or commercially share account access.
- Impersonate another person, or misrepresent your affiliation with anyone.
- Harass or abuse other users or our staff.
Security research
Good-faith security research and responsible disclosure do not violate this section. If you believe you have found a vulnerability, please report it to us promptly and give us a reasonable opportunity to address it before disclosing it publicly. While investigating, please do not access, modify, or delete another person's data, and do not degrade the Services for anyone else.
9. Course and Test Integrity
Studying with practice questions, reviewing explanations of questions you missed, and taking practice examinations are ordinary, legitimate parts of preparing for an aviation examination. That is what the Services are for.
Examination integrity is a different matter. You agree not to:
- Upload, submit, solicit, or distribute live or otherwise protected examination content that has been improperly obtained.
- Use the Services as unauthorized assistance during an examination where outside assistance is prohibited.
- Otherwise take part in the deliberate compromise of an examination.
10. Subscriptions, Trials, and Billing
Paid plans are not yet available. This section sets out the terms that will apply to Premium when it launches, so that they are clear in advance.
Airworthy Academy will offer a free tier and paid Premium plans. The price that applies to you is the one shown to you when you subscribe.
- Premium Monthly
- $19.99 per month, renewing monthly until you cancel.
- Premium Annual
- $199.99 per year, renewing annually until you cancel.
Prices are in US dollars and exclude any taxes that may apply, which are added where required.
Free trials
We may offer a seven-day trial of a Premium plan. A valid payment method is required to start one, and trials are limited to one per customer. We do not intentionally place an authorization hold for the full subscription price to start a trial, though your bank or card issuer may carry out an ordinary verification check.
Before your trial begins, we will show you the plan you selected, its price, how long the trial runs, the exact date of your first scheduled charge, and the fact that the subscription converts automatically unless you cancel.
We will send a reminder to the email address on your account at least 48 hours before that first charge, unless you have already cancelled. At the end of the trial your subscription converts to the plan you selected and your payment method is charged, unless you cancelled before then.
Automatic renewal
Premium subscriptions renew automatically — monthly for monthly plans, annually for annual plans — until you cancel. Each renewal charges the payment method on your account. For annual plans we provide renewal notices as required by applicable law.
Price changes
We may change our prices. Where a change would affect your existing subscription, we will give you advance notice before the new price applies to you, and you can cancel before it takes effect.
If a payment fails
If a payment does not go through, we may retry it and may give you a reasonable period to update your payment method before Premium access ends. Losing Premium access because of a failed payment does not by itself mean your account or your study history is deleted.
11. Cancellation and Refunds
Cancelling
You can cancel your subscription yourself, online, at any time. There is no cancellation fee, and we will not put obstacles in the way of cancelling.
Cancelling stops future renewals. It does not remove access you have already paid for: your Premium access continues through the end of your current paid billing period, and we will show you the exact date it runs through. After that date you will not be charged again unless you choose to subscribe again, which you are welcome to do at any time.
We may ask why you cancelled. Answering is entirely optional and is never a condition of cancelling.
Cancelling does not close your account or delete your study history. Your account remains, so you can return later and pick up where you left off. Deleting your account is a separate request — see our Privacy Policy.
Refunds
Payments for completed and current billing periods are generally non-refundable, except where applicable law requires otherwise or where these Terms say otherwise.
We will always correct our own billing mistakes. If you are charged in error, or charged twice for the same period, tell us and we will put it right.
We may also choose to provide a refund or account credit in exceptional circumstances. Doing so in one case does not oblige us to do so in another.
We do not offer a refund based on the outcome of any examination.
12. Airworthy Academy Intellectual Property
We retain all rights in our original and proprietary material, including our curriculum, the organization and structure of our lessons, our original explanations, graphics, videos, software, simulations, original practice questions, and branding.
We do not claim ownership of United States government works, or of third-party material, that appears in or is referenced by the Services.
Your licence to use our material
While your account is in good standing, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use our material for your own education and study.
Ordinary personal study is fine. That includes taking your own notes, taking reasonable screenshots for your own study use, and quoting a limited amount of material to discuss a concept with your instructor or for a similar legitimate study purpose.
What is not permitted:
- Substantial redistribution of our material, whether or not you charge for it.
- Any commercial redistribution or resale, including reselling question banks.
- Cloning or reproducing our curriculum.
- Repackaging our material as another course or product.
- Systematic scraping or extraction of our content to build a competing product, dataset, or model.
13. Your Content
You keep whatever ownership rights you already have in what you submit to the Services — your notes, your questions, your prompts, documents you upload, and anything else you provide. Submitting something to Airworthy Academy does not transfer ownership of it to us.
To run the Services, we need permission to handle what you submit. You grant us a non-exclusive licence to do the following, and only for the purpose of operating and providing the Services to you:
- Host and store your content.
- Process it as needed to provide the feature you are using.
- Display it back to you.
- Transmit it to, and have it processed by, the service providers involved in a feature you invoke.
- Make technical copies and backups.
This licence does not permit us to use your content for unrelated purposes. Using your AI conversations to improve our AI or our products is governed separately by the opt-in described in “AI Features and Our Curated Curriculum” above.
You are responsible for having the rights or permission you need for any third-party material you submit.
14. Feedback
If you voluntarily send us suggestions, product ideas, feature requests, or other feedback about Airworthy Academy, we may use it to improve the Services without owing you compensation or any other obligation.
This section applies only to feedback you choose to send us about the Services. It does not apply to your notes, your documents, your study data, or your conversations with our AI features, which are covered by “Your Content” above and by our Privacy Policy.
15. Service Availability and Changes
We work to keep the Services running well, but we do not guarantee that they will be uninterrupted or error-free, that every feature will remain available permanently, or that every piece of information will be current at every moment.
We may carry out maintenance, change or improve features, replace the providers we rely on, and add or discontinue features as the product develops.
Where a change would materially affect a paid Service you are using, we will give you reasonable notice where it is practical to do so or where the law requires it. If we discontinue a paid feature in a way that materially affects what you subscribed to, the treatment described in “Suspension and Termination” below applies.
16. Third-Party Services
The Services rely on third parties for things like hosting, authentication, payment processing, email delivery, and — where such features exist — AI processing. The Services may also link to third-party websites and resources.
We do not control third-party services or the content they provide, and we are not responsible for them. Their own terms and privacy practices apply when you use them.
17. Disclaimers
Except as expressly stated in these Terms, the Services are provided “as is” and “as available.” To the fullest extent permitted by applicable law, we disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- You will pass any examination, or obtain any certificate, rating, or endorsement.
- You will qualify for any medical certificate, or obtain employment.
- The Services will be uninterrupted, timely, secure, or error-free.
- Our material will be complete, or current to the minute.
- Responses generated by AI features will be accurate.
Nothing in this section limits any express commitment we make elsewhere in these Terms, including our commitments about cancellation and billing.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you. Nothing here removes rights you have that cannot lawfully be waived.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Airworthy Academy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, or lost or delayed training, certification, or employment outcomes, arising out of or relating to the Services or these Terms.
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid us in the twelve months immediately before the event giving rise to the claim, or (b) US $100.
Some jurisdictions do not allow certain limitations or exclusions of liability. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and where a limitation is not permitted, it does not apply to you.
19. Indemnification
If a third party brings a claim against us because of your material breach of these Terms, your infringement or misappropriation of someone else's rights, your fraud, or your unlawful misuse of the Services, you agree to defend and indemnify us against that claim, including reasonable legal costs, to the extent permitted by applicable law.
This does not apply to any claim to the extent it arises from our own conduct. We will notify you promptly of any claim we seek indemnification for, and we may participate in the defence with our own counsel. Neither of us will settle a claim in a way that imposes an obligation or admission on the other without that party's consent.
20. Suspension and Termination
You may stop using the Services at any time, and you can cancel a subscription as described in “Cancellation and Refunds” above.
How we enforce these Terms
Where it is appropriate, we take a proportionate approach: a warning first, then restricting a feature, then suspension, and termination last.
Some conduct justifies immediate suspension or termination without that sequence — for example fraud, attacks on the Services, serious security abuse, deliberately selling or sharing account access, or serious misuse of our intellectual property.
If we end a paid subscription
If we end your paid subscription for our own convenience, and not because of anything you did wrong, we will either let your access continue through the period you have already paid for, or give you an appropriate prorated refund for the unused part of that period.
If we terminate your access for serious misconduct, refunds are not provided except where applicable law requires them.
Sections that by their nature should continue after your account ends — including those covering intellectual property, your content, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — survive termination.
21. Resolving Disputes
We do not require arbitration, and nothing in these Terms asks you to give up your right to take part in a class action.
Talk to us first
If something goes wrong, we would like the chance to fix it. Please contact us first and describe the problem and what you would like us to do about it. We will make a good-faith effort to resolve it with you informally, and we ask that you give us a reasonable period — normally 30 days — to do so before starting formal proceedings.
This step is not a precondition to relief you need urgently, to seeking injunctive relief, or to bringing a claim in small-claims court, and it does not extend or shorten any deadline that applies to your claim by law.
If we cannot resolve a dispute informally, it may proceed through the courts or any other mechanism legally available to you.
22. Governing Law
These Terms, and any dispute arising out of or relating to them or to the Services, are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
This does not deprive you of the protection of mandatory consumer protection laws that apply where you live, or of any other rights you cannot waive by agreement.
23. Changes to These Terms
We may update these Terms as Airworthy Academy develops. We will not make changes in a deliberately obscure way.
For minor or administrative changes, posting the updated document with a new “last updated” date may be all that is needed, where that is legally appropriate.
For material changes that affect your rights or obligations, we will give you reasonable advance notice by email, by a prominent notice in the product, or both, and we will tell you when the change takes effect. Where applicable law requires your fresh affirmative consent, we will ask for it. If you do not agree to a material change, you can cancel before it takes effect.
24. Contact
If you have questions about these Terms, or need to raise something covered by “Resolving Disputes” above, email us at support@airworthyacademy.com.
For questions about how we handle personal information, see our Privacy Policy.
